This web site (the “Site”) is operated by The Rum Club Australia (“us”, “we”, “our” or “The Rum Club Australia”). Your use of the Site is subject to these Terms and Conditions, which you accept by using or purchasing a product(s) from the Site. These Terms of Use may be updated by us from time to time and at any time without notice to you. The current version is always available on the Site.
2. RESPONSIBLE SERVICE OF ALCOHOL
You must be 18 years of age or older to make any type of purchase on this Site. Failure to comply with result in immediate cancellation of your membership. The Rum Club Australia supports the responsible service of alcohol. New South Wales: Liquor Act 2007. It is against the law to sell or supply alcohol to, or to obtain alcohol on behalf of, a person under the age of 18 years. Victoria: WARNING: Victoria Liquor Control Reform Act 1998: It is an offence to supply alcohol to a person under the age of 18 years (Penalty exceeds $17,000), for a person under the age of 18 years to purchase or receive liquor (Penalty exceeds $700). Western Australia: WARNING. Under the Liquor Control Act 1988, it is an offence: to sell or supply liquor to a person under the age of 18 years on licensed or regulated premises; or for a person under the age of 18 years to purchase, or attempt to purchase, liquor on licensed or regulated premises. South Australia: Liquor Licensing Act 1997, Section 113. Liquor must NOT be supplied to persons under 18. Queensland: Under the Liquor Act 1992, it is an offence to supply liquor to a person under the age of 18 years. If you do not meet these criteria, you agree to not use this Site and exit immediately. The Rum Club Australia reserve the right to request further information such as photo ID and credit card information for validation of age, identity and address for security purposes. Failure to comply with requests for further information may result in cancellation of the order in question.
3. SHIPPING
Delivery Times
Estimated delivery times: Typically, deliveries via the Australia Post e-Parcel service occur between 3-5 business days for destinations on the east coast, however for others locations, and regional destinations, please allow up to 10 business days to receive your order. Please note that COVID-19 disruptions may cause additional delays on top of estimated delivery times.
Shipping Costs
The Rum Club Australia delivers to almost everywhere in Australia, with the exception of some parts of the Northern Territory and Australian external territories. The Rum Club Australia does not currently ship to international destinations outside of Australia.
Shipping within Australia is a low flat rate $14.99 for the 1 BOTTLE SUBSCRIPTION, with complementary FREE SHIPPING offered with the 2 BOTTLE SUBSCRIPTION or when 2 or more bottles of the Rum-of-the-Month are purchased in a single month.
Delivery to PO Boxes and Parcel Lockers is available, however the use of Australia Post as a carrier is at our discretion. The Rum Club Australia reserves the right to ship via any carrier of our choosing. Where a courier partner is used, The Rum Club may specifically request a street address (private or business address). Please note The Rum Club Australia does not allow local pickup at this time.
4. PRIVACY POLICY
What information do we collect?
We collect information from you when you register on our site, place an order, subscribe to our newsletter or fill out a form. When ordering or registering on our site, as appropriate, you may be asked to enter information such as your: name, e-mail address, mailing address, phone number and credit card information. You may, however, visit our site anonymously.

We offer the use of a secure server. All supplied sensitive/credit information is transmitted via Secure Socket Layer Enhanced Verification (SSL) technology to our Payment gateway provider only and are not stored or processed on our servers. This encrypted information is only accessible by those authorized with special access rights to such systems, and are required to keep the information confidential.

5. PRODUCT IMAGES AND PHOTOGRAPHY
Please note that in some circumstances the membership or subscription product images and photo may not match exactly the product that you receive. There may be subtle differences in the packaging, volume, size, or included accessories. Often we do not want to open an item or break a seal to photograph the actual product, but we will do our best to accurately represent the item.
Most photos on the site are copyright The Rum Club Australia. You must seek the express permission of The Rum Club Australia to use our photos. Failure to seek permission to use our photos is a breach of Terms of Use of this Site and a breach of the relevant copyright Laws applicable in New South Wales, Australia.
6. CANCELLATION POLICY
The Rum Club Australia will endeavour to resolve any issues with regard to refunds & replacements with a 100% money back guarantee*. Freight charges will apply on returned items and will be incurred by the purchaser. It is up to the purchaser to return the items in their original condition including any original packaging that came with the item before any refund can be processed. If eligible for a refund, The Rum Club Australia will refund the advised amount in full upon receipt of the items using the same method of payment as the original purchase. In certain exceptional circumstances, we will reserve the right to not accept returns or offer refunds. This will be at our discretion. The Rum Club Australia does not accept cancellations or returns for incorrectly chosen products under any circumstances, so please choose carefully. *Order cancellations for the Rum-of-the-Month after the monthly charge already been processed will attract a 3% cancellation fee (unfortunately this is passed on from our credit card payment provider) and a 2% restocking fee (5% in total).

Parts of the Site are accessible to all users and other parts of the Site are restricted to users who have registered with us (“registered users”). Unless otherwise stated, these Terms of Use apply to all users, including registered users. We may, in our sole discretion, decline to register anyone as a registered user without giving any reasons. The Site is proprietary and you may not copy anything on it. All copyright and other rights (including, without limitation, intellectual property rights) in and to the Site and the material (the “Content”) on the Site are owned by us or by others.
